Provisional Regulation respecting the land register

PRELIMINARY PROVISION
This Regulation applies only to registry offices established for registration divisions of Québec that, on
9 October 2001, have not been the subject, pursuant to section 237 of the Act to amend the Civil Code and other legislative provisions relating to land registration (2000, c. 42), of a notice of the Minister of Natural Resources stating that they are fully computerized for land registration purposes or with respect to which the date fixed in the notice has not occurred.
This Regulation remains applicable, for each of those offices, until the date fixed in the notice of the Minister of Natural Resources stating that that office is fully computerized for land registration purposes ; as of that date, the Regulation respecting land registration made pursuant to article 3024 of the Civil Code becomes applicable to that office.

CHAPTER ONE

§ 1. General
1.
The registers kept in registry offices of registration divisions shall be established either according to the corresponding model attached to this Regulation or according to the model referred to in section 8, 10, 11 or 16.

Every leaf of the index of immovables, of the register of real rights of State resources development and of the register of public service networks and immovables situated in territory without a cadastral survey shall bear a heading indicating the register to which it belongs, the name of the registration division and the date on which the leaf is opened.
Furthermore, the heading of the leaf shall include
(1) for the index of immovables: the number of the immovable delineated on the cadastral plan to which the leaf relates and the name of the cadastre;
(2) for the register of real rights of State resource development: the serial number of the leaf and the nature of the right for which that leaf is opened;
(3) for the register of public service networks and immovables situated in the part of the registry office's territory that has no cadastral survey: the serial number of the leaf and the nature of the network or an indication that the immovable is situated in territory without a cadastral survey.
Once opened, a leaf that is not kept on a computer system shall be signed by the registrar.

Every application shall be numbered in consecutive order and shall bear, under the registrar's signature, the date, hour and minute of its presentation.
The registrar shall keep the application intended to form part of the office's records and shall return any additional copy to the person who applied for the registration.

Any omitted entry shall be added after the last entry in the register along with the date, hour and minute of the addition. If there are other entries between the date of the addition and the date on which the entry was omitted, a reference to the new entry shall appear where that entry should have been made. Any omitted mention or entry shall be added in the margin of a document along with the date, hour and minute of the addition.
Any correction of a clerical error in an entry or a certificate for registration in the register or in a mention or entry in the margin of a document shall be made by crossing out the error, in such a manner that the crossed out text remains legible, and by overwriting the correct information along with the date, hour and minute of the correction.
Notwithstanding the first and second paragraphs, in the offices of the Laval and Montréal registration divisions, if the register concerned is kept on a computer system, every addition of an omitted entry or deletion of an entry shall be dated. Every addition of an entry shall be made after the last entry appearing in the register.

The following shall be kept in each registry office :
(1) an index of names;
(2) an index of immovables;
(3) a register of real rights of State resource development;
(4) a register of public service networks and immovables situated in the part of the registry office's territory that has no cadastral survey;
(5) a directory of holders of real rights of State resource development and owners of public service networks or immovables situated in territory without a cadastral survey; and
(6) a complementary register.
In the Laval and Montréal registration divisions, a directory of memorials of presentation shall also be kept.

§ 2. Memorial of presentation
8.
The memorial of presentation shall be numbered in consecutive order.
In the offices of the Laval and Montréal registration divisions, the entry-book shall be continued, for the same purposes, under the name Directory of memorials of presentation, according to the model in use on 1 January 1994. In both those registration divisions, any memorial may be consulted upon request.

Memorials may also be used by the registry office for the purpose of fixing and collecting the exigible fees and for billing purposes.

§ 3. Index of names
10.
The index of names shall be continued according to the model in use on 1 January 1994. It shall be kept in alphabetical order of the names of all holders and grantors of rights designated in the applications that are published in it.

§ 4. Index of immovables
11.
The index of immovables shall be continued according to the model in use on 1 January 1994.

§ 5. Register of real rights of State resource development
12.
The registers provided to registrars to be used as registers of real rights of State resource development are loose-leaf binders with sheets measuring 215 mm by 355 mm in keeping with the model in Schedule I.
The leaves in the register of real rights of State resource development shall be assigned a number composed of the following elements, separated by a dash:
(1) the first element is the code of the registration division, as recorded in the directory of cadastre codes kept by the Ministère des Ressources naturelles;
(2) the second element is the letter A;
(3) the third element is a number in a single consecutive series beginning at 1.
The leaves in the register of real rights of State resource development shall be filed, in each registration division, according to the consecutive order indicated by the third element in the number.

§ 6. Register of public service networks and immovables situated in territory without a cadastral survey
13.
The registers provided to registrars to be used as registers of public service networks and immovables situated in territory without a cadastral survey are loose-leaf binders with sheets measuring 215 mm by 355 mm in keeping with the model in Schedule II.
The leaves in the register of public service networks and immovables situated in territory without a cadastral survey shall be assigned a number composed of the following elements, separated by a dash:
(1) the first element is the code of the registration division, as recorded in the directory of cadastre codes kept by the Ministère des Ressources naturelles;
(2) the second element is the letter B;
(3) the third element is a number in a single consecutive series beginning at 1.
The leaves in the register of public service networks and immovables situated in territory without a cadastral survey shall be filed, in each registration division, according to the consecutive order indicated by the third element in the number.

§ 7. Directory of holders of real rights
14.
The directory of holders of real rights that must be kept by registrars to complete the register of real rights of State resource development and the register of public service networks and immovables situated in territory without a cadastral survey is made up of files measuring 215 mm by 355 mm in keeping with the model in Schedule III.
For each holder of a real right of State resource development and for each owner of a public service network or an immovable situated in territory without a cadastral survey, a personal file shall be opened in each registration division where the holder holds a real right of development, or where the owner owns a network or an immovable situated in territory without a cadastral survey.
Each file shall refer to the serial number of the related leaf in the register of real rights of State resource development or in the register of public service networks and immovables situated in territory without a cadastral survey.

The files shall be kept under the names of the holders of real rights in alphabetical, alphanumerical or numerical order.

§ 8. Complementary register
16.
The complementary register shall be used to extend and continue the entries made in the margin of documents forming part of the registry office's records; it shall be continued according to the model in use on 1 January 1994. Where the margin of a document is filled up, the registrar shall continue it in the complementary register and shall write at the bottom of the last leaf of the document that the margin is continued in the complementary register, specifying the leaf and number of that register.

24.
Any person wishing to present an application for registration in a registry office shall use 215 mm X 355 mm paper weighing at least 75 g/m 2 per ream for the application intended to form part of the office's records.
The foregoing also applies to any other document whose preservation is prescribed by law.

An application for registration may not be a carbon copy; it may be handwritten, typed, printed or photocopied. The ink used shall be of good quality. The characters shall be clear, neat, legible and durable.
Where the application for registration must be entered in the index of names or in the directory of holders of real rights that completes the register of real rights of State resource development and the register of public service networks and immovables situated in territory without a cadastral survey, the names of the grantors and holders of rights shall appear in block capitals. Given names shall appear in small letters.

An application for registration shall be drawn up on both sides of the sheet, so that the bottom of the front side is the top of the reverse side.
Each sheet shall have a margin
(1) of at least 63 mm on the left side;
(2) of at least 12 mm on the right side; and
(3) of at least 50 mm at the top and bottom.

Where an application for registration is made by presenting an authentic copy of an original title issued by the Registrar of Québec or the Keeper of the Archives nationales and intended to form part of the registry office's records, that copy shall be on paper measuring 215 mm by 355 mm weighing at least 75 g/m 2 per ream. Such application may be hand-written, typed, printed or photocopied.
The foregoing also applies to an application for registration made by presenting a copy of an Order in Council intended to form part of the registry office's records. Such copy shall also be certified true in accordance with section 3 of the Act respecting the Ministère du Conseil exécutif (R.S.Q., c. M-30).

Where an application is in the form of an authentic act other than a notarial act en brevet, the applicant shall present 2 extracts from or authentic copies of the application; where the application is in the form of a notarial act en brevet or in private writing, the applicant shall present the original in duplicate.

For the reduction or cancellation of a registration, a single copy of the application may be presented. The foregoing also applies where presentation of a single copy of the application is prescribed by law, as in the case of minutes of seizure and prior notices of sale for failure to pay immovables taxes.
Where only one copy of an application is presented, that copy shall be certified on special request only, either on an authentic copy or on a duplicate, if the application is made in the form of a notarial act en brevet or in private writing.

The summary intended to form part of the registry office's records shall be presented with an authentic copy of or extract from the document summarized if the document is an authentic document other than a notarial act en brevet, or with the document summarized if the document is a notarial act en brevet or in private writing.

The summary shall be signed by the person who applies for the registration.
The summary shall state:
(1) the date and place where it is made, the date of the summarized document and the place where that document was drawn up;
(2) in the case of a notarial act, the name of the notary, the place of his professional domicile and the number of the act en minute or the indication that the act is en brevet;
(3) in the case of a judicial act, the court that issued it, the judicial district, the court record number and, in the case of a judgment, the conclusions of the judgment;
(4) in the case of an act in private writing, the names of the witnesses who certified it, where such certification is prescribed by law;
(5) the nature of the document and, where applicable, the date on which the registration requested ceases to have effect;
(6) in the case of a sale or an exchange, an indication of the price or the consideration;
(7) in the case of a hypothec, the sum for which it is granted and the nature of the hypothec.

The notices required by law shall indicate the date and place where they were made, the person concerned by the notice and the person giving notice. They shall be signed by the person giving notice and, where that person is not the beneficiary thereof, shall indicate the designation of the beneficiary.
Such notices shall specify their nature and, where applicable, the nature of the document concerned and the registration number of that document.

A notice of renewal of the publication of a right shall specify the right in question and the place, date, registration number and nature of the document evidencing the right.
A notice of renewal of the registration of an address shall specify the registration number of the notice of address that a person wishes to renew, the registration number of the request pertaining to that notice, the right in question, except in the case of a hypothec, and the name of the registration division in which the immovable subject to the right is situated.
A notice of renewal of the publication of a right may apply to that renewal and to the renewal of the registration of an address recorded with respect to that right provided only that an application made especially for that purpose, referring to the notice of address in question, appears in the notice of renewal of publication of the right.

37.
A notice of advance registration of a judicial demand shall contain the designation of the parties and shall indicate the court and the court record number. It shall also indicate the nature of the demand and of the right that is the subject thereof and, where applicable, the registration number of the document concerned.

A notice of advance registration of a will shall designate the testator and shall indicate the date of the death. That notice shall also indicate the nature of the right claimed by a person and the reason for the advance registration.

An application for registration of the address of a person referred to in article 3022 of the Civil Code of Québec shall be in the form of a notice indicating the beneficiary of the registration and the address where notification must be made, as well as the nature and, where applicable, the registration number of the right concerned or, in the case of a hypothec, of the document. A single copy of the notice may be filed.
Where several legal persons appear on a same application for registration, a separate registration of address shall be made for each of them.
Notwithstanding the foregoing, where a legal person has already published its address in the registry office of a registration division, it suffices, in any act concerning an immovable situated within the territory of that registry office, to refer, immediately after the designation of the legal person, to the registration number of that address and, except in the case of a hypothec, to specify the right opposite which the registration of the address number will be entered.

40.
A notice of a change in the address or name of a person referred to in article 3022 of the Civil Code of Québec shall indicate the registration number of the notice of address already filed and the registration number of the document to which that notice relates. It shall also specify, where applicable, the former and new address or the former and new name of the beneficiary of the notice. A single copy of the notice may be filed.
Where the notice concerns a legal person, the number of the document to which the former notice relates need not be indicated.

40.1.
The notice of amendment to the reference to the registration number of an address shall state the nature and registration number of the document in question and the former and current references in the registration number of the address.
The notice of entry of a reference omitted in the registration number of an address shall state the registration number of the document in question and the reference to the registration number of the address. In addition, it shall specify the right in respect of which the registration number of address will be entered, except for a hypothec.
Two copies of the notice of amendment or of entry must be filed.

The registration number of any address shall be recorded in the appropriate register opposite the document concerned. A specific entry may also be made for that number and shall refer to the registration number of the document to which the notice relates.
The notice of a change in the address or name of a legal person shall be substituted for the notice of address it replaces, under the same registration number.

The address at which the notification must be made shall be indicated clearly and shall include the postal code if the address is in Canada or, if the address is outside Canada, the equivalent of the postal code, if such equivalent exists.

In addition to the particulars required under article 2999.1 of the Code, the notice must contain, where applicable, the names of the lessees, whether assignors or assignees, and the nature of the modification made to the lease.
In case of transfer of, modification to or cancellation of the lease, the reference to the lease required under article 2999.1 of the Code is made by specifying the registration number of the lease or the number of the notice governing the registration of the rights arising therefrom in the register.

A notice concerning the registration of a document on a leaf opened in a land file under a serial number shall refer to the application to which it relates, shall state the designation contained in that application and shall specify the serial number of the leaf on which the entry is required.

45.1.
Where a copy of an act, of an extract or of a summary is submitted to the registrar under section 12 of the Act respecting registry offices (R.S.Q., c. B-9), the application for registration shall indicate the name of the local municipality in whose territory the immovable concerned is located and any other items needed to complete the address of that immovable.

The certificate prescribed shall appear at the end of each copy of the application below the signatures of the parties, or shall be appended to each copy of the application to which it relates.
Where such a certificate is appended, it shall refer to the application to which it relates by indicating the nature and date of the application, the place where it was signed and the names of the parties thereto.

The entries shall be clear, accurate and consecutive, without blanks, scratches, overwritings or interlineations.

An entry in the appropriate register shall indicate the date on which the application for registration was presented, the persons designated therein and the nature of the document for which the application for registration is being made. It shall refer to the registration number of the application and shall be supplemented, where applicable, with brief indications in the «comments» column on the register leaf.
Where there is more than one grantor or holder of the right, it suffices to indicate the name of the first person designated as such in the application, followed by the words «and others».

The entry for the registration of a transfer or of a subrogation in a hypothecary claim, or of the hypothec of a claim secured by an immovable hypothec, shall refer to the claim and to its registration number. Notwithstanding article 3014.1 of the Code, the hypothec of a claim secured by an immovable hypothec shall be mentioned in the margin of the application evidencing the claim.

The registry office is open every day, except Saturdays and the days referred to in article 6 of the Code of Civil Procedure (R.S.Q., c. C-25).
Applications may be presented between 9 a.m. and 3 p.m. and documents may be consulted on the premises between 9 a.m. and 4 p.m.
Notwithstanding the second paragraph, the office is open from 9 a.m. to 10 p.m. on 24 and 31 December.

59.1.
The certified statement issued pursuant to article 3019 of the Code must contain, in addition to the type of certified statement, the name of the person requesting it, the lot number given to the immovable and the name of the cadastre in which it is situated, or the serial number of the file relating to the real right, the network or the immovable and the name of the register in which the file is recorded, the name of the registration division in which the immovable is situated, the right or the network, the name of its owner or holder, as the case may be, the period for which the certified statement is issued and all registration numbers of the applications in question, if any.
The certified statement, dated and signed by the registrar issuing it, shall be completed, where applicable, by the copies of the applications for registration in question, with the accompanying documents where they are in the form of a summary and, where applicable, an extract from the complementary register related to each application.

The registrar is required to issue, to any person requesting it, a copy of or an extract from any document having entailed an entry in the register and shall, in such a case, mention on the copy or extract any renewal, transfer, subrogation, hypothec of a claim secured by an immovable hypothec, reduction or cancellation mentioned in the margin of the document.
